Australia – Voluntary certification scheme for manufacturers of modern construction methods proposed

The Australian Building Codes Board has published an issues paper for developing a National Voluntary Scheme for Manufacturers of Modern Methods of Construction as well as consistent definitions for the National Construction Code (NCC). Stakeholder feedback is sought on the issues paper to enable prefabricated and modular construction manufacturers to meet the NCC requirements. The scheme will be ready for state and territory adoption and any legislative amendments by mid-2027, whilst the Commonwealth is scheduled to implement the scheme in mid-2028.

Australia – Model WHS laws best practice review begun

Safe Work Australia has announced a best practice review of the model WHS Act and Regulations and has published the terms of reference. Consultation on a discussion paper will commence in September 2025 with the final report to be provided to WHS ministers in mid-2026.

New South Wales – Bill for workplace protections and administrative changes passes through Parliament

The Industrial Relations and Other Legislation Amendment (Workplace Protections) Bill 2025 has passed through parliament and has now assented. Parts of the Act commenced on 3 July 2025, comprising provisions for anti-discrimination and other administerial changes to the Industrial Relations Act 1996 and Industrial Relations (General) Regulations 2020. The remainder of the Act is awaiting commencement proclamation, but will address bullying and sexual harassment in the workplace. It will also make administrative amendments to the Work Health and Safety Act 2011 due to SafeWork NSW becoming a standalone regulator, and will include duties regarding approved codes of practice, provisional improvement notices and work health and safety disputes, among other things.
