Quickly Identify the Environmental Legislation in Victoria that Affects Your Operations

EnviroLaw Victoria summarises environmental legal obligations from about 250 pieces of legislation applicable in Victoria, including State and Commonwealth Acts, Regulations, Policies and Orders. These obligations are arranged into 13 main topics and further into sub-topics, and we provide a search engine for finding specific information.

 

We list 71 mandatory codes of practice and guidelines and just over 100 mandatory standards called up in Victorian and Commonwealth legislation.

 

Along with the individual environmental legal obligations, we include more than 120 EPA Guidelines, 60 Department of Environment Publications and many publications from other authorities, all of which help you achieve and maintain compliance with the legislation, other compliance obligations and keeping your environmental management system in line with the latest environmental legislation.

 

Descriptions of the more common offences (and maximum penalties) and notices used to enforce compliance are also included in EnviroLaw Victoria.

A Snapshot of the legislation covered in Victoria

Environment Protection Act 1970

We have extracted 29 obligations from the Act itself. While the 450 pages of the Act deal mainly with creation and maintenance of a legislative framework for protection of the environment, it also includes these 29 obligations for companies and other organisations.

Environment Protection (Industrial Waste Resource) Regulations 2009

We have extracted 28 obligations from these Regulations. They deal with a variety of topics from rules about dilution of hazard waste to waste consignment (to waste contractors) and vehicle permitting.

Environment Protection (Scheduled Premises and Exemptions) Regulations 2007

While there are only 3 obligations from this legislation, they deal with the important topic of requirements for site licensing and works approvals. They also outline a number of exemptions to these requirements.

State Environment Protection Policy (Air Quality Management)

We summarise 10 obligations from this Policy, dealing with (among other things) emission limits, waste burning, odour, dust and greenhouse emissions.

State Environment Protection Policy (Control of Noise from Commerce, Industry and Trade)

The 6 obligations extracted from this Policy deal with management of noise, noise limits and some requirements for new plant.

State Environment Protection Policy (Waters of Victoria)

We have arranged the extensive obligations from this Policy into 13 obligations dealing with discharge emissions, contingency planning, wastewater reuse and recycling and 6 obligations applicable specifically to sites in the Yarra River catchment.

Waste Management Policy (National Pollutant Inventory)

While there is only one obligation from this Policy, it gives full details of the requirements for NPI reporting, including reporting thresholds, the timing of reporting and a link to the various emission-estimation technique manuals (via the NPI website).

Water Act 1989

We have extracted 15 obligations from the 800 pages of this Act. They deal with topics such as water restrictions, discharges to sewer, water licensing, water bores and recycling of water.
