Western Australia – Updated Mine Closure Plan (MCP) Guideline released

The Department of Energy, Mines, Industry Regulation and Safety has released the Guideline for Preparing Mine Closure Plans following consultation (see previous Bulletin here), as well as the response to submissions it received. The Guideline will commence when amendments introduced by the Mining Amendment Act 2022 become operational, currently expected in August 2025. Until then, MCPs must meet the form and content of the current MCP guidelines.

New Zealand – Changes to Wildlife Act announced

The New Zealand Government is looking to update the Wildlife Act 1953 following a court ruling that found the Department of Conservation acted unlawfully in allowing the NZ Transport Agency to cause harm to protected wildlife during an infrastructure project. The change aims to provide legal clarity for developments like renewable energy, forestry and powerline maintenance, while still protecting native species.

Northern Territory – Aboriginal Sacred Sites Act and Regulations to be updated

The Northern Territory Government has introduced the Northern Territory Aboriginal Sacred Sites Legislation Amendment Bill 2025 to Parliament, which would update the Aboriginal Sacred Sites Act 1989 and its regulations to ensure they remain contemporary and effective in fulfilling their purpose. The Bill will also strengthen protections for sacred sites, reduce red tape, and support greater efficiency within the Aboriginal Areas Protection Authority.
