‘Proposed final’ environment protection regulations, ERS, and incorporated publications and guidance released

The proposed final versions of the Environment Protection Regulations, Environment Protection Transitional Regulations and Environmental Reference Standard (ERS) have been released to assist duty holders in preparing for the intended commencement of the Regulations and amended Environment Protection Act 2017 on 1 July 2021.

 

The proposed final versions are not yet legislation, however they represent the endorsed position of the VIC Government and reflect changes made following public consultation in 2019. Additionally, supporting documentation have been released, five of which will be incorporated into the new Regulations, while others provide a navigational overview of the proposed final Regulations, as well as an explanation of the regulatory frameworks for waste and noise pollution.

Plastic Reduction Bill introduced

The ACT Government has introduced the Plastic Reduction Bill 2020 into Parliament. The legislation aims to reduce the use of plastic and its impact on the environment and is expected to commence from July 2021. The first tranche of single-use plastics to be banned includes cutlery, drink stirrers and expanded polystyrene takeaway food and beverage containers.

Mass balance reporting requirements to commence

The EPA has announced that requirements for mass balance reporting will commence on 1 July 2021. Certain licensed waste facilities will be required to report on the monthly tonnages of waste and other matter received, stockpiled, used, disposed of, or transferred. These requirements will be introduced into the Environment Protection Regulations 2009 by the Environment Protection (Mass Balance Reporting And Other Measures) Variation Regulations 2020.
