This environmental bulletin provides information about selected Australian national and state legislation, and New Zealand national legislation, that is upcoming and under review.  It also offers information on draft publications and a selection of recent fines and prosecutions. 

This bulletin has been collated by Environment Essentials from selected Australian and New Zealand government and other websites. It is published every two months - it is therefore recommended that you do not rely solely on it for upcoming information.  Exclusions.

Australia – Biodiversity - Environment Protection and Biodiversity Conservation (EPBC) Act review released
The review of the EPBC Act – “The Australian Environment Act: Report of the Independent Review of the Environment Protection and Biodiversity Conservation Act 1999” – was presented to Parliament on December 20 2009.

The report proposes an integrated reform plan revolving around a number of elements which include:

  • streamlining approvals through:

    • earlier engagement in planning processes
    • more use of strategic assessments, bioregional planning and approvals bilateral agreements

  • creating a new matter of national environmental significance for ‘ecosystems of national importance’ and introducing an interim greenhouse trigger.

The report includes 71 recommendations to help implement the reform plan. The Commonwealth government is now considering its response.  More.

Australia – Greenhouse - Draft Carbon Pollution Reduction Scheme (CPRS) Regulations released – Closed for comment
Revised regulations to establish the emissions-intensive trade-exposed (EITE) assistance program, under the Carbon Pollution Reduction Scheme Bill 2009, have been released for public consultation.  Comments have closed.  More.

Australia – Renewable energy - Draft Renewable Energy Target (RET) Exemptions Regulations released – Closed for comment
The Commonwealth government has released draft regulations to deliver partial exemptions from liability under the RET for activities that would qualify for assistance under the Carbon Pollution Reduction Scheme (CPRS) emissions-intensive trade-exposed (EITE) assistance program.  Comments have closed.  More.

Australia – Renewable energy - Renewable Energy Target (RET) issues papers released – Closed for comment
As part of negotiations on the Carbon Pollution Reduction Scheme, the Commonwealth government has released two issues papers for public consultation:

  • Discussion Paper 4 – the treatment of new waste coal mine gas power generation in the RET

  • Discussion Paper 5 – the treatment of ‘Solar Credits’ Renewable Energy Certificates under the RET.

NSW – Water – Water management inquiry underway – Open for comment until 19 Feb
The Legislative Assembly is investigating the likely impact of climate change on the availability of water resources under different climatic scenarios. The investigation includes approaches to managing water resources by all water users, including provision for environmental flows and best practice in water conservation and management. Comments close 19 February 2010. More.

QLD – Radiological materials – Increased security requirements proposed
The Queensland government has introduced a Bill to give effect to the recommendations of the Review of Radiological Materials by adoption of the National Security Code. This will require a range of physical and procedural security measures to be implemented, as well as requiring people dealing with high risk radioactive materials to undergo a security background check. VIC – Biosecurity - Plant Biosecurity Bill Exposure Draft released – Open for comment until 26 Feb
The Plant Biosecurity Bill Exposure Draft will replace the Plant Health and Plant Products Act 1995. The objectives of the Bill are to prevent plant pests and diseases from entering and spreading within Victoria, and to improve market access for Victorian plants and plant products.  Key pests that will be managed under this Bill include fruit flies, potato cyst nematode and grape phylloxera.  Comments close 26 February 2010.  More.

VIC – Environment effects- Environment effects process inquiry underway – Open for comment until 31 Mar
The Parliamentary Environment and Natural Resources Committee is conducting an inquiry into Victoria’s environmental effects statement process, including the operation of the Environment Effects Act 1978. The inquiry will investigate:

  • any weaknesses in the current system, including poor environmental outcomes, excessive costs and unnecessary delays

  • community and industry consultation

  • the independence of environmental effects examination when government is the proponent

  • how better environmental outcomes can be achieved more quickly and predictably and with fewer unnecessary costs.

VIC – Land – Changes to Planning and Environment Amendment Act proposed – Open for comment until 12 Feb
The draft Planning and Environment Amendment (General) Bill, which sets out to amend the Planning and Environment Act 1987, has been released for comment.

The key reforms incorporated into the draft Bill include:

  • updating Victoria’s planning objectives

  • improving the amendment and permit processes

  • a new process for projects declared as State significant development.

WA – GM crops – Review of GM-Free Areas Act completed
The review of the Genetically Modified Crops Free Areas Act 2003 has been completed. A report was tabled on 26 November 2009. More.

QLD – Environment – Draft State Planning Policy for Air, Noise and Hazardous Materials released – Open for comment until 26 Feb
The Department of Environment and Resource Management has released a draft policy for air, noise and hazardous materials. The policy will help protect the health and wellbeing of individuals and the community from adverse impacts of air and noise emissions, and hazardous materials, while preserving the viable operation of industrial activities in Queensland. Comments close 26 February 2010. More.
 
QLD – Heritage – Recommendations from review of indigenous cultural heritage acts released – Open for comment until 19 Feb
Recommendations from a DERM review of the performance of the Aboriginal Cultural Heritage Act 2003 (Qld) and Torres Strait Islander Cultural Heritage Act 2003 (Qld) have been released for public comment.  Recommendations address issues raised in submissions. Comments close 19 February 2010. More.

QLD – Koala protection – Draft State Planning documents released – Open for comment until 28 Feb
A draft State Planning Regulatory Provision (SPRP) and a State Planning Policy (SPP) for South East Queensland Koala Conservation have been released for comment.  The SPRP and SPP give direction to local governments and State agencies on how land use planning should consider koala conservation.  Comments close 28 February 2010. TAS – Chemicals - Agricultural and Veterinary Chemicals Discussion Paper released - Open for comment until 10 Feb
An independently-prepared discussion paper on agricultural and veterinary chemicals has been released for comment.  The paper is associated with the review of the national regulatory framework for the chemicals. Comments close 10 February 2010.  More.

TAS – Water – Draft Sassafras Wesley Vale Water Management Plan released – Open for comment until 19 Feb
The draft Sassafras Wesley Vale Water Management Plan, which provides a framework for managing the catchment's water resources, has been released for public comment. Comments close 19 February 2010. More.

VIC – Noise – Draft guideline on industry noise in regional Victoria released
Open for comment until 26 Mar
The EPA has released the draft guideline Noise from Industry in Regional Victoria (NIRV) for public comment.  This guideline assists government approval bodies and applicants to understand how to address noise during proposals.  It includes recommended maximum noise levels for industrial and commercial premises outside of Melbourne.  Supporting NIRV is a draft guideline on statutory approvals relating to noise, such as planning permits, works approvals and licences. Consultation sessions and workshops are planned.  Comments close 26 March 2010.  More.

WA – Water – Draft Perth-Peel Regional Water Plan released – Open for comment until 31 Mar
The Department of Water has released a draft water plan, the Perth-Peel Regional Water Plan 2010-30. Comments close 31 March 2010. More.

Fines and prosecutions

 

Australia & VIC – Construction company pays $200,000 for destroying critical grasslands
A Melbourne construction company must pay a total of $200,000 towards conservation initiatives after breaching national and Victorian environment laws at an Ardeer industrial site.  The company cleared 0.7 hectares of critically endangered natural temperate grasslands of the Victorian Volcanic Plain, which also serves as important habitat for the critically endangered spiny rice flower and the vulnerable striped legless lizard. NSW – Breach of licence conditions leads to $90K costs
Failure to repair or replace filter bags in a metallurgical manufacturing plant has led to a fine of $65,000 plus $26,000 costs. More

SA – $30,000 fine for sediment discharge
A South Australian water authority has been fined $30,000 after discharging more than 940,000 litres of sediment into the Palmer and Tungkillo waterways. More.

VIC – Council fined for unlicensed dumping
A Victorian council has been fined $5,841 for receiving industrial waste (hydrocarbon waste including cutting oil, bitumen and diesel) it was not licensed to accept at its Violet Town landfill.  More.

VIC – Water corporation fined for sewage spill
A Gippsland water corporation has been fined $5,871 for a 200,000 litre sewage spill that flowed into a wetland area and Waterhole Creek at Maryvale.  More.

VIC – Bio-diesel company fined for poor environmental performance
A Laverton North bio-diesel company has been fined $5,841 for breaching its EPA licence by failing to store waste in a secure area.   More.

VIC – Caravan park fined for sewage discharge
A Westmeadows caravan park has been fined $5,841 after a blocked sewer caused 2 – 5,000 litres of raw sewage to flow into Moonee Ponds Creek.  More.

WA – Waste – Increases to landfill levy now in effect
The Waste Authority has increased the landfill levy by 300% for Category 63 (inert landfill) and Category 64 & 65 (putrescible landfill), under the Waste Avoidance and Resource Recovery Levy Act 2007. The increases commenced on 1 January 2010. More.

NSW – Delay in acting on clean-up notice leads to $157,000 costs
A small asbestos-removal company is nearly $160,000 poorer because it was late in complying with a condition in a clean-up notice. As part of the notice, the Council required the company to provide an expert report and action plan. The company provided these three months after they were due. Even though the expert concluded there was minimal environmental risk, the court deemed that failing to meet the deadline undermined the Protection of the Environment Operations Act.  More.
