This OHS bulletin provides information about Australian national and state legislation, and New Zealand national legislation, that is upcoming and under review.  It also offers information on draft publications, campaigns being run by authorities and a selection of recent fines and prosecutions.

Australia - OHS - Safe Work Australia still to be established
Following the withdrawal of the Safe Work Australia Bill, Workplace Relations Ministers have agreed to establish Safe Work Australia as an Executive Agency prescribed under the Financial Management and Accountability Act 1997.  More

Australia - OHS - Second report on harmonised safety laws released
The second report on harmonising OHS laws in Australia has been released. View report.

Australia - Plant - Comment invited on new plant regulation - Open for comment until 15 May
The National Standard for Plant, declared in 1994, is under review. The Australian Safety and Compensation Council (ASCC) has released a discussion paper on Safety Requirements for the Design, Manufacture and Conformity Assessment of Plant and invites comment.  Comments close 15 May 2009.  More

VIC – Dangerous goods - Storage and handling under review
The Dangerous Goods (Explosives) Regulations 2000 and the Dangerous Goods (Storage & Handling) Regulations 2000 sunset in 2010. WorkSafe has commenced projects to review the regulations. Stakeholders will be invited to participate. More.

Australia - Comcare - Induction to construction work under review - Closed for comment
Comcare is proposing to add induction for construction work to the Occupational Health and Safety Code of Practice 2008.  Comments have closed.  More.

NSW – OHS - Certificates of competency for formwork and explosive-powered tools progresses further - Closed for comment
WorkCover has released the outcomes of its review of certificates of competency for formwork and explosive-powered tools. All three options proposed have been assessed for their impact on government, industry and the community.  Comments have closed. More. 

NSW – Mining - Guidance document on management of musculoskeletal disorders released
The Musculoskeletal Disorders (MSD) Working Party has published the draft guidance document The Management of Musculoskeletal Disorders in the Mining and Extractives Industry.  Comments have closed.  The draft will go to the NSW Mine Safety Advisory Council before its full public release.  More

WA - Electricity - RIS on proposed equipment regulations released
EnergySafe Victoria has released a Regulatory Impact Statement for the Proposed Electricity Safety (Equipment) Regulations 2009 for review. The key goal of these regulations is to reduce the number of accidents associated with electrical appliances. View RIS.

Campaigns

Australia - OHS - National campaign for new and young workers in hospitality industry underway
Workplace safety authorities across Australia have launched a national workplace safety campaign targeted at new and young workers in the hospitality industry.  In Victoria, in April and May, cafes and restaurants in Fitzroy, Collingwood and St Kilda will be targeted. VIC - Bricklaying campaign now underway
From March, WorkSafe will be inspecting building sites to assess bricklaying OH&S.  More.

WA - Seafood processing to be targeted by WorkSafe
WorkSafe has launched an inspection campaign in the seafood processing industry with a view to reducing injuries and illness. More.

NSW - Fall of 15 m leads to $343,000 fine
The principal contractor and subcontractor at a Rhodes construction site have been fined a total of $343,500, after a worker fell 15 m.  More. 

NSW - $230,000+ for hand crush injury
A grain mill company and its director have been fined $220,000 and $16,500 respectively after a worker's hand was crushed between unguarded rollers.  More.

NSW - Company convicted and fined $100,000 over electrocution
Following the electrocution of its maintenance manager, a company has been fined $110,000 plus costs. More.

NSW - Roofing contractor fined after three-metre fall
A roofing contractor has been fined $35,000 after a worker was injured at Capalaba in May 2007.  More.

SA - Construction company fined $20,000 over steel structure collapse
A construction company has been fined $20,000 after a wind gust led to framework collapsing.  Three workers were injured.  More

SA -Tuna processor fined after worker's foot crushed
A fish processor has been fined $15,000 after a worker's foot was crushed when a lid fell from a tuna bin he was cleaning.  More.

QLD - Labour hire company fined $57,000 after falling steel beams kill worker
A worker's death when four large steel beams fell from a semi trailer during loading has led to a $57,000 fine for a labour hire company.  More

QLD – Collapsing deck leads to worker injuries and fines
A formwork company has been fined $35,000 after two workers were injured when a deck collapsed.  More.

QLD - Training provider fined after trainee's death
A workplace training provider has been fined $13,000 after a participant was killed during a chainsaw course.  More.

VIC – House re-stumping company fined $100,000 over worker’s death
A re-stumping company has been fined $100,000 after an employee died when a house he was re-stumping collapsed on him.  More - click here and go to page 3. 

VIC - Car company fined $70,000
A car company has been convicted and fined $70,000 after a worker was hit by falling metal ventilation ducts. 3.5 tonnes of furnace sand had built up in the fume extraction ducts that fell and there was 2.5 tonnes in another section.  More.

VIC - Contractor death leads to local council prosecution
A council's failure to apply its contractor management procedures contributed to the death of a grader driver, a court has found.  More. 

VIC - $11,000 for ignoring improvement notices
Failing to act on three safety improvement notices has cost a Rochester metal fabrication company three convictions and $11,000 in fines and court costs.  More.

WA - $60,000 fine for stone slab death
The death of a worker who was crushed between stone slabs has led to fines of $60,000 for his employer.  More

NZ - Record fine for recyclers’ amputation accident
A recycling plant has been fined $100,000 and ordered to pay reparation of more than $76,000 after a worker had his legs amputated when he fell into a baling machine.  The machine was not guarded.  More

NZ - $480,000 for canyon disaster; adventure tourism industry urged to improve OSH
The Department of Labour is urging the adventure tourism industry to review its health and safety systems, following the death of seven people during a flash flood while canyoning.  A company has been required to pay fines and reparations of $480,000 over the incident.  More.

NZ - Company and director fined after concrete panel kills worker
A construction company and its director have been fined $45,000 and $18,000 respectively, after a falling concrete panel killed a worker.  More.

Australia - Hazardous Substances Information System to be updated
The Australian Safety and Compensation Commission (ASCC) is about to update the Hazardous Substances Information System (HSIS) online database to include information to reflect changes in Europe's 30th Adaptation to Technical Progress to Directive 67/548/EEC.  More

Australia - Transport and logistics - New safety Code released
The Australian Logistics Council has released a National Logistics Safety Code (NLSC).  The voluntary code applies to road transport and OH&S compliance.  It provides minimum operating standards to meet legal requirements. More.

QLD - Information sessions on traffic management for construction and maintenance Code to be held
Workplace Health and Safety is holding information sessions on the 2008 Code of Practice for Traffic Management for Construction or Maintenance Work in April.  More.

NZ - Outdoor workers' health at risk from sun, study finds

Outdoor workers are at risk of eye disease and skin cancer because of overexposure and under-protection in the sun, a University of Otago study has found. More.

Australia - Fatality a reminder not to rely on administrative systems
The electrocution of a worker from overhead power lines when using a mobile crane has highlighted the importance of employers not relying on paper systems to maintain workplace safety.  Actual work sites must also be inspected. More.
